Old vs New Tax Regime: How to Choose Before You File Your ITR

By Ledgicore Nexus LLP • August 18, 2026 • 6 min read

Every year at filing time the same question comes up: should you file under the old tax regime or the new tax regime? There is no single right answer — it depends entirely on your income and how many deductions you actually claim. Here is a practical way to think about it.

The core trade-off

The new regime offers lower slab rates but removes most common exemptions and deductions. The old regime keeps higher rates but lets you reduce taxable income through deductions such as those under Section 80C, house rent allowance, home loan interest and more.

  • New regime — simpler, fewer deductions, lower slab rates. It is now the default option unless you opt out.
  • Old regime — more paperwork, but valuable if you have a home loan, pay significant rent, or invest heavily in tax-saving instruments.

A simple rule of thumb

If your deductions and exemptions are small, the new regime often works out cheaper because of its lower rates. If you claim a large amount in deductions — a home loan plus 80C plus HRA, for example — the old regime can still come out ahead. The only reliable way to know is to compute your liability under both and compare.

Points people miss

  • Salaried taxpayers get a standard deduction under both regimes — you do not lose it by choosing the new one.
  • Your choice can affect TDS deducted from your salary, so it is worth deciding early in the year, not just at filing time.
  • Business and professional taxpayers have different rules for switching between regimes, so get this checked.
